Health Care Proxy is a legal document in which a person can appoint someone to make decisions about medical treatment in the event that he or she is no longer mentally competent or able to communicate.
The New York Health Care Proxy Law lets you select someone you have confidence in, for instance, a relative or intimate acquaintance – to make well-being choices for you if you lose the capacity to make evaluations on your own.
By selecting a health care proxy, you can make certain that wellbeing choices suppliers respect your requests. Your representative can also choose how your desires evolve as your health changes.
Health care providers,, hospitals, doctors and others must follow your proxy’s decisions as if they were yours. You may give the person you select as your well-being proxy as little or as much power as you desire.
You can give your representative the ability to make only certain one’s or all health care decisions. With this form you can dictate what must be done on your behalf.
The Health Care Proxy form can also be used to record your requests or directives with respect to tissue or organ donations.
The Terms you need to Know about Health Care Directives:
- Living Wills and Durable Powers of Attorney for Health Care are both types of Health Care Advance Directives.
- Advance Directive – The generic term for any document that gives instructions about your health care and/or appoints someone to make medical treatment decisions for you if you cannot make them for yourself.
- Living Will – A document in which you state your wishes about life-sustaining medical treatment if you are terminally ill, permanently unconscious, or in the end-stage of a fatal illness.,
- Durable Power of Attorney for Health Care – A document in which you appoint someone else to make medical treatment decisions for you if you cannot make them, for yourself.
- The person you name is called your agent, proxy, representative, or surrogate.
- You can also include instructions for decision-making.
